MetLife and Amy Hopkins Lose yet again

in this long-term disability insurance case, MetLife paid benefits long enough to enable the plaintiff to obtain Social Security disability benefits.  MetLife, then collected its reimbursement and terminated the claim.

MetLife's doctors included Amy Hopkins, Kevin Smith, Leonard Sonne and Leonid Topper.

MetLife, never asked for an independent medical examination, and the court ruled that "the failure of MetLife to exercise its right to an independent medical and.  He is an important factor in determining if MetLife's decision to deny benefits was the product of a principled and deliberative reasoning process."

The court found that there was no basis for MetLife's rejection of the treating physician's findings and the 14 reports he had submitted supporting disability.

The case is Eaton vs. MetLife and it was decided by the Eastern District of Oklahoma in September 2009.
